The 2-Year PERM Delay: Why Waiting for a US Labor Certification is Riskier Than Learning French
Summary: The first step in the US employment-based green card process is the PERM labor certification, a Department of Labor process designed to prove no US worker can fill your role. Historically a nuisance, the PERM process has now devolved into a massive, multi-year bottleneck. Processing times and random audits have pushed the timeline beyond 2 years, trapping highly skilled workers on temporary visas and placing them at extreme risk of deportation if they are laid off. Instead of gambling their futures on a dysfunctional government agency, thousands of US-based professionals are spending that 2-year wait learning French and securing Canadian Permanent Residence as an impenetrable backup plan.
The PERM Crisis: A Broken Bottleneck
For any professional on an H-1B or L-1 visa hoping to secure an employment-based US green card (EB-2 or EB-3), the journey begins with the Program Electronic Review Management (PERM) labor certification.

The 2-Year PERM Delay: Why Waiting for a US Labor Certification is Riskier Than Learning French
The purpose of PERM is for your employer to prove to the Department of Labor (DOL) that they conducted a good-faith recruitment effort and could not find a qualified US worker for your position.
Before the pandemic, this was a frustrating but manageable administrative hurdle. Today, it is a crisis.
The Current PERM Timeline Reality:
Prevailing Wage Determination (PWD): Before filing a PERM, your employer must obtain a PWD from the DOL. This step currently takes 6 to 8 months.
Recruitment Period: Your employer must run ads and interview candidates. This takes 2 to 3 months.
PERM Processing Time: Once filed, the DOL is currently taking over 12 months just to review the application.
The Audit Risk: If your application is randomly selected for an audit, add another 6 to 9 months to the timeline.
In total, an employee starting the green card process today will likely wait 2 to 2.5 years just to complete Step 1.
Why the Delay is Dangerous
During this 2-year window, you are incredibly vulnerable.
You cannot easily change jobs or accept a major promotion, because doing so requires restarting the entire PERM process from scratch. You are essentially frozen in your current role.
If your employer conducts layoffs during the recruitment period, the DOL will immediately freeze the PERM application, forcing you back to square one.
If you are laid off during this 2-year wait, your PERM dies with your employment. You have 60 days to find a new sponsor, start over, and hope your temporary visa (like the H-1B 6-year max) doesn't expire before the new PERM is approved.
For many professionals, waiting for PERM is a daily exercise in anxiety, knowing that a single corporate restructuring could end their American life.
The Canadian Express Entry Bypass
While the US Department of Labor forces you to wait 2 years just to prove you are worthy of applying for a green card, the Canadian immigration system offers a radically different paradigm.
Canada’s Express Entry system is a fast, modernized, points-based pathway to Permanent Residence (PR). It does not require a PERM equivalent. You do not need a Canadian employer to sponsor you, run newspaper ads, or prove that no Canadian can do your job.
If you have the required Comprehensive Ranking System (CRS) points, you receive an Invitation to Apply (ITA) and can secure your PR entirely on your own merits.
The Problem with the General Pool
For US-based applicants without Canadian work experience, clearing the standard all-program CRS cutoff (which routinely hovers above 500) is almost impossible.
This is why French is the ultimate bypass.

The Francophone Strategy: Weaponizing the Wait Time
Immigration, Refugees and Citizenship Canada (IRCC) conducts category-based draws specifically for candidates who can demonstrate an NCLC 7 (roughly B2 level) on the TEF Canada or TCF Canada exam.
The CRS cutoffs for these francophone draws are drastically lower—historically falling between 336 and 400.
If you are a highly skilled professional waiting on a US PERM application, you already have the degrees and experience to clear 400 points. By achieving NCLC 7 in French, you guarantee yourself an ITA for Canadian PR.
The strategic brilliance lies in the timeline.
If you know the US PERM process is going to take 2 years, you have a massive window of time. Instead of spending those 2 years anxiously refreshing the DOL processing times portal, you can spend 1 to 2 hours a day learning French.
Months 1–12: Build a solid grammatical foundation and reach B1 level.
Months 13–18: Focus heavily on TEF/TCF exam prep and take the test in the US.
Months 19–24: Submit your Express Entry profile, get invited in a francophone draw, and receive your Canadian PR approval.
By the time your US employer finally gets your PERM certification approved, you will already be a Canadian Permanent Resident.
The Ultimate Hedge
If you eventually receive your US green card, great. But if you are laid off, if the PERM is audited and denied, or if you simply cannot endure the subsequent decades-long backlog (for Indian and Chinese nationals), you do not face deportation. You simply pack your bags and move to Toronto or Vancouver, fully documented as a Permanent Resident.
How PrepMyFrench Makes NCLC 7 Achievable

The US PERM process is no longer a functional system; it is a multi-year gamble where the employee assumes all the risk. Waiting passively for a government agency to decide your fate is a dangerous strategy.
By investing the exact same time into learning French, you can take control of your immigration destiny. You bypass the US labor certification, bypass the 500+ CRS Express Entry cutoff, and secure unconditional permanent residency in Canada. Your skills got you to North America; let your French keep you here permanently.
